The HIPAA statute (with its accompanying regulations) and other privacy laws are almost certainly the most misunderstood healthcare laws currently in force. Almost everyone has heard any casual acquaintance say something like HIPAA says I dont have to do X [or that you cant do Y], many of which statements are grossly incorrect. In this webinar, we will discuss the basic parameters of HIPAA privacy and security obligations and those compared against state law in Texas (with some selected comparisons to other jurisdictions). We will also discuss the special level of protection given to records related to mental health, substance abuse, and HIV status. Finally, we will discuss issues in privacy that are still very much being worked out, due to emerging technologies and other developments in the industry.
