There is currently very little legal, regulatory, and legislative guidance on the safe and effective use of this new technology. Absent such guidance, leaders struggle with whether, and how, to safely incorporate AI into their practices. In this workshop, we will review proposed legal, regulatory, and legislative approaches currently considered by federal and state authorities. We will review the existing black letter law and explain how it is applied to AI in health care. We will also explain how existing administrative guidance and directives can be interpreted to help prepare for the inevitable passage and implementation of future laws. We will also provide a brief overview of the international landscape with regard to AI regulation and how it might influence US regulation.
